USCIS RULES FOR FILING K-1 VISA APPLICATION
Meet the K-1 Eligibility Requirements
Before filing Form I-129F, make sure both partners are legally free to marry and genuinely intend to marry within 90 days after the K-1 beneficiary is admitted to the United States. In most cases, the couple must also have met in person at least once during the two years immediately before filing, unless USCIS grants an applicable exception.
Submit Strong & Complete Evidence
A well-prepared K-1 petition should include the required supporting documents and clear evidence demonstrating that the couple meets the K-1 requirements, including evidence of the in-person meeting and mutual intent to marry. Always follow the current Form I-129F instructions and carefully review your packet before filing, because missing required initial evidence can lead to delays, requests for additional evidence, or potentially a denial.
As of August 2026, I would avoid calling all eight items below “new USCIS rules.” Several are long-standing K-1 requirements, while USCIS has updated filing instructions, fees, and payment procedures over time. For your website or YouTube content, a more accurate title is “8 Important USCIS Rules and Filing Requirements for a K-1 Fiancé(e) Visa in 2026.” USCIS’s current Form I-129F page was updated on May 29, 2026.

Rule no. 1
The petitioner must be a U.S. citizen. A U.S. citizen uses Form I-129F, Petition for Alien Fiancé(e), to petition for a foreign fiancé(e) to come to the United States for marriage.

Rule no. 2
Meet in Person Within Two Years. Couples generally must have met face-to-face within the two years before filing Form I-129F, with limited exceptions.

Rule no. 3
Both parties must be legally free to marry. Any previous marriages must be legally terminated, and the petitioner must show that both partners are legally able and genuinely willing to marry.

Rule no. 4
Intend to Marry Within 90 Days. Both partners must genuinely plan to marry each other within 90 days of the fiancé(e)’s K-1 admission to the United States.

Rule no. 5
Use the Current Form I-129F. Always check USCIS for the latest form edition, filing instructions, location, and required evidence before submitting.

Rule no. 6
Pay the Correct USCIS Filing Fee. Check the current I-129F fee and accepted payment methods before submitting your petition.

Rule no. 7
Previous K-1 Petitions May Affect a New Filing. Petitioners with prior K-1 filings may face filing limits and could need a USCIS waiver.

Rule no. 8
I-129F Approval Does Not Guarantee a K-1 Visa. The fiancé(e) must still complete visa processing and the interview and qualify for admission to the United States.

K-1 Fiancé(e) Visa Application Process
The K-1 Fiancé(e) Visa allows an eligible foreign-citizen fiancé(e) of a U.S. citizen to travel to the United States to marry the U.S. citizen petitioner, with the marriage required to take place within 90 days of admission. The process begins when the U.S. citizen files Form I-129F, Petition for Alien Fiancé(e), with USCIS and provides the required supporting documentation, including evidence that the couple meets the applicable K-1 requirements. After USCIS approves the petition, the case is forwarded to the National Visa Center (NVC) and then to the appropriate U.S. Embassy or Consulate, where the foreign fiancé(e) completes Form DS-160, undergoes the required medical examination, gathers supporting documents, and attends a visa interview. If the K-1 visa is issued, the fiancé(e) may travel to the United States and must marry the U.S. citizen petitioner within 90 days of entry; after the marriage, the foreign spouse may apply for Adjustment of Status to lawful permanent residence if eligible. Because requirements and procedures can vary by case and U.S. Embassy or Consulate, applicants should always review the latest official instructions before filing or attending their interview.
